How the Spousal Open Work Permit Fits Into the Full Sponsorship Timeline

The open work permit is a separate application from the PR sponsorship. Your spouse cannot apply

for it the moment you submit the PR application. The trigger is the Acknowledgment of Receipt (AOR)

letter.

  3. IRCC issues the AOR, typically 4 to 8 weeks after submission

  4. Spouse applies online for the open work permit using LMIA exemption code A74

For sponsored spouses applying through outland sponsorship, the same open work permit pathway

applies provided the spouse is physically present in Canada. The old requirement to file inland to

access a work permit no longer exists. You can use outland sponsorship for faster PR processing

and still obtain the open work permit.

exception applies: IRCC allows the work permit application without the AOR if status expires within

14 days of submission, and the PR application has already been filed. This puts the spouse into

maintained status while the work permit is processed. This exception is preventative only. If status

What Affects Spousal Open Work Permit Processing Time?

The 259-day estimate is an average. Your specific timeline depends on several factors:


Application completeness. A single missing document can return your file to the back of the queue.

Completeness at the time of submission is the single biggest factor within your control.


Biometrics. If your spouse has not provided biometrics in the past 10 years, a Biometric Instruction

Letter will be issued. Biometrics must be completed at a Service Canada location before IRCC can

finalize background checks. Delays in booking the biometrics appointment directly extend your wait.


Medical exam. Required in some circumstances. Must be completed by a panel physician

designated by IRCC.


Background and security checks. Complex travel history, prior immigration refusals, or security

concerns add processing time with no set timeline.


LMIA exemption code errors. Family Class sponsorship applicants use code A74 (SCLPC FC

OWP). Economic class PR applicants whose spouses are bridging from an existing work permit use

2026 Rule Changes That Affect Spousal Open Work Permit Eligibility

Two major policy changes now affect who qualifies and when.


January 21, 2025. IRCC significantly restricted open work permits for spouses of temporary workers

and international students. After this date, spouses of temporary workers qualify only if the principal

applicant holds a TEER 0 or TEER 1 occupation. Spouses of students qualify only if the student is

enrolled in a Master's or Doctoral program of at least 16 months or a specific professional degree

program.


March 4, 2026. IRCC updated program delivery instructions to refuse C42 open work permit

applications where the principal international student is in their final academic term. Applications

submitted before March 4, 2026 are grandfathered. Renewals are subject to the new restriction.


Family Class sponsorship (code A74) is unaffected by both changes. If you are sponsoring your
